Here is the general Process for Filing a Divorce in Ontario

1. Contact Us

The initial step in the divorce process is to arrange a free consultation with an experienced divorce lawyer at out firm. During your consultation, we will evaluate your case and be available to answer any queries you may have.

2. Information Exchange

Our team will need some information from you. We will be asking a few questions to understand your current situation in order to start your divorce proceedings on the same day.

3. Court Filing

In a matter of days, your paperwork for divorce will be submitted to the Ontario Superior Court and you’ll be able to have the initial court hearing.

4. Serving Spouse

In a sole divorce, we will serve the court-stamped divorce papers to your spouse. This is done by regular mail, which we will carry out for you.

5. Affidavit of Divorce

After the papers have been delivered to your spouse and all of the set requirements are fulfilled, it is time for us to draft your affidavit of divorce. This document will be geared towards court proceedings.

6. Court Filing

In order to complete the process of divorce, it is necessary for us to submit your affidavit along with all requisite documents to the courthouse.

7. Divorce Judgment

An Ontario Superior Court Judge will decide whether to grant your divorce based on the information and paperwork that is filed.

8. Final Divorce

When a divorce has been legally granted, it’s finalized within the next 31 days.
